Government Contracting

The firm has over 20 years experience in government contracting, especially with the Department of Defense.  We have many clients who are government contractors and subcontractors.

Pre Award

The firm helps government contractors review and negotiate Teaming Agreements and Nondisclosure Agreements.  We also provide clients will template agreements for their own use.

Post Award

The firm is experienced in negotiating government contracts, and negotiating subcontracts with prime contractors.  The firm is knowledgeable with the Federal Acquisition Regulation clauses (FAR clauses) and Defense Federal Acquisition Regulations Supplement clauses (DFARS clauses).  We pay special attention to our client’s rights and responsibilities including but not limited to its rights relating to intellectual property created under the contract.

Technical Data and Defense Articles Compliance

Department of State, Directorate of Trade Controls Compliance

The firm consults and advises companies pursuing export registration with the Department of State, Directorate of Trade Controls.  The firm handles compliance issues related to the International Traffic in Arms Regulations (ITAR), including but not limited to, Voluntary Disclosures, Manufacturing License Agreements, Technical Assistance Agreements, and licensing of foreign employees.  We advise clients regarding Commodity Jurisdiction Determinations and aid in the submission and appeals process.  If found to be under the jurisdiction of the Department of State, the firm consults and advises companies on the formation and implementation of a Compliance Program Policy.

Foreign Corrupt Practices Compliance.

The firm advises and consults companies regarding compliance with the Foreign Corrupt Practices Act, which forbids persons and entities to make payments to foreign government officials to assist in obtaining or retaining business.

Organizational Conflict of Interest

According to FAR 9.502(c), “an organizational conflict of interest may result when factors create an actual or potential conflict of interest on an instant contract, or when the nature of the work to be performed on the instant contract creates an actual or potential conflict of interest on a future acquisition.”  The firm helps companies avoid, identify, and mitigate organizational conflicts of interest.
